Backstreet Boys’ Nick Carter Gets Away From Sexual Assault Lawsuit

LAS VEGAS – The singer of the Backstreet Boys, Nick Carter, got a favorable judgment in one of two civil lawsuits filed against him in Nevada, one by a woman who alleges he raped her on his tour bus in Washington state in 2001 and another from a woman who accuses him of sexually assaulting her on his yacht off the Florida coast in 2003.

A state court judge on Wednesday refused to dismiss a countersuit Carter and his attorneys filed alleging defamation by three people in the first case, which was filed last December by a Nevada woman, now 40, who claims that Carter attacked her on her tour bus after a concert in Tacoma, Washington, when she was 17 years old.

“He told the plaintiff that he would go to jail if she told anyone what happened between them,” the woman’s lawsuit states. “He said he was Nick Carter and that he had the power to do that.”

The other case related to the Florida allegations was filed Monday in Clark County District Court.

Carter, who is now 43 years old, lives in Las Vegas. He has denied the allegations of sexual assault and emotional distress that the two women leveled against him. Each woman is seeking unspecified monetary damages in excess of $30,000.

Carter appeared with his attorney in court Wednesday when Clark County District Court Judge Nancy Allf refused to dismiss the countersuit in which Carter charges three people with defamation, tortious conspiracy and abuse of legal process, including a third woman who accused him of raping her in 2003.

The judge’s decision means that the woman, Melissa Schuman, and her father, Jerome Schuman, will have to respond to Carter’s accusations that they have waged a campaign against him to profit from his fame. Carter is seeking more than $2.3 million in damages.

“For years, Melissa and Jerome Schuman have conspired with anyone they could manipulate to bring false accusations against Nick Carter in a brazen attempt to enrich themselves at his expense,” Carter’s attorney, Liane Wakayama, said in a statement Thursday to The Associated Press.

Schuman failed to get prosecutors to file a criminal complaint against Carter in California in 2018 based on her allegation that he forced her to have sex in her Los Angeles-area apartment.

Carter has denied Schulman’s accusations that he raped her. She did not speak during Wednesday’s court hearing.

Attorney Alan Greenberg, representing the Schumans, argued in court that Carter was a public figure, that the allegations against her are unfounded and that Melissa Schuman told two friends and a therapist in 2003 that she had been sexually assaulted.

The Associated Press does not typically identify people who say they have been sexually assaulted, but Schuman has spoken publicly about her experience and approved the use of her name.

Carter’s lawyers maintain that the Schumans did not go public with their allegations until late 2017, after a broad social movement fueled by the #MeToo hashtag began exposing never-before-revealed cases of sexual violence.

Carter’s defense also alleges that the Schumans “recruited” the woman who accused him of sexual assault in Florida.

That plaintiff, who lives in York County, Pennsylvania, asks in court papers to be identified only by her initials. She claims Carter raped her on her yacht in 2003, when she was 15, and they met in Marathon, Florida.

“This case illustrates how much time, courage and perseverance it takes for victims and survivors to report child sexual abuse and seek justice,” Margaret Mabie, the New York-based attorney for the woman, said in a statement.

“Despite numerous complaints about Carter’s past conduct toward young women, his victims continue to fight to hold him publicly accountable for the harm he has caused them,” Mabie said.

The Backstreet Boys formed in 1993 and released hits like “I Want It That Way”, “As Long as You Love Me” and “Everybody (Backstreet’s Back)”.
