Controversy before the Supreme Court over the proposed location of solar farms

A group of environmental organizations asked this Thursday the Supreme Court to review the determinations of the lower forums regarding a lawsuit against the government that seeks to prevent the development of solar farms on land that – it is alleged – is protected due to its high agricultural or ecological value.

The “certiorari” appeal presented by the six plaintiff entities indicates that the rulings of the Court of first instance (TPI) and the appeals court delegate to him Puerto Rico Energy Bureau (NEPR) the “exclusive” power to decide whether the location of projects complies with the provisions of the Land Use Plan (PUT), despite the fact that the body has refused to have jurisdiction over the matter.

The ruling unfairly and arbitrarily refers the appearing parties to a forum that it denies having and consistently declares itself without jurisdiction to consider and apply the Special Agricultural Reserve and the PUT.. It has the direct consequence of requiring those appearing here to attend an administrative and judicial review process that has already been exhausted,” the entities stated, referring to the NEPR.
