Court of Appeals modifies suspended sentence of Carlos Maldonado Davila, who will serve two years in prison

A panel of appeals court ordered, this Thursday, to modify the suspended sentence of 10 years in prison issued on November 9, 2023 by Judge Nerisvel Duran Guzman against Carlos Julian Maldonado Davila, convicted of causing the death of Natalia Nicole Ayala Rivera, so that he serves two years in prison and, the rest of the sentence, on probation.

The panel composed of judges Maritere Brignoni Martyr, Carlos Candelaria Rosa, Alicia Alvarez Esnard and Karilyn Diaz Rivera accepted the arguments outlined by Justice Department and the Office of the Attorney General, in a petition for certiorari filed on December 11, 2023, to review Duran Guzman’s decision by maintaining that he should have considered more carefully the circumstances in which the convicted person committed the crime, since “they denote a serious problem of character, and that ample information emerges from the present report to determine that he should be admitted to a penal institution.”.

In addition to the suspended sentence, Duran Guzman ordered Maldonado Davila to pay over $11,000 in fines. The man ran over Ayala Rivera in events recorded on January 4, 2022. Ayala Rivera stopped, at 11:20 pm, in the area of ​​the promenade of an elevated road towards the PR-22 highway, in San Juan, for a tire empty when it was hit by the former director of Tourism of Barceloneta, who fled.
