Court revokes determination that allowed the Department of the Family to use the color blue in advertising despite the electoral ban

He appeals court revoked the sentence of Court of first instance that allowed the family Department (DF), during the electoral year, continue using and distributing blue shirts – the color that identifies the New Progressive Party (PNP)- among its employees in violation of the electoral banwhich began last January.

Likewise, the appellate judicial forum revoked another previous ruling that would have allowed the same agency to continue using flags andblue backdrops with the logo of the public agency. Both matters had been disallowed by the Office of the Electoral Comptroller (OCE) and the DF chose to go to court.

“When weighing all the issues that accompany the use of said articles, and how it is intended to continue using them during the electoral ban period, it is inescapable to conclude that the use of these, by employees of the Department of the Family, during events officials of said agency, will have or may have the effect of achieving the linkage of the colors, logo, official activity and agency, with the government that currently holds power, the PNP, and is in the middle of an election campaign in which it interests be re-elected,” the Court of Appeals concluded in its ruling.
