Federal judge refuses to acquit the husband of Maria Milagros “Tata” Charbonier

The federal judge Silvia Carreno Coll refused to acquit Orlando Montes Riverahusband of former representative Maria Milagros “Tata” Charbonier, of the guilty verdict against him.

In an extensive 33-page order and opinion issued this Wednesday, Carreno Coll pointed out that Montes Rivera’s petition sought for the judge to express whether she would have found him not guilty if the decision had been in her hands, but he stressed that Rule 29 of acquittal does not allow such a determination.

The judge, however, still opted for a “careful review” of the record and precedents “to determine whether the jury made inferential leaps insufficiently supported by evidence” and found that “they did not do so.” She ruled that “accordingly, the court declines to vacate Montes’ convictions and denies the motion” for acquittal.
