How would Texas law work to detain migrants suspected of crossing illegally?

McAllen, Texas — One law of Texas that would allow the state detain and deport people who enter the United States illegally is suspended for nowwhile a federal appeals court reviews it.

A panel of three judges from the Federal Court of Appeals for the 5th Circuit heard arguments on Wednesday in a lawsuit filed by the Department of Justice against the latest escalation of measures to prevent illegal border crossings promoted by the Republican governor of Texas, Greg Abbott. The panel did not say when it might rule.

The U.S. Supreme Court allowed the law to take effect for a few hours Tuesday, before the 5th Circuit issued an order blocking its implementation.

The Department of Justice affirmed that Texas is invading the jurisdiction of the federal government in immigration matters. Texas maintains that it has the right to take action against what the governor described as an “invasion” of migrants at the border.
