Judge rejects Alec Baldwin’s request to dismiss involuntary manslaughter charge

New Mexico – A judge of New Mexico on Friday rejected a request for Alec Baldwin to dismiss the only criminal charge against him for a fatal shooting on the set of the movie “Rust,” keeping the case on track for a trial this summer.

Judge Mary Marlowe Sommer upheld an indictment charging Baldwin with one count of involuntary manslaughter in the 2021 death of cinematographer Halyna Hutchins. The judge rejected defense arguments that prosecutors broke the rules of grand jury procedures to divert attention from exculpatory evidence and witnesses.

Special prosecutors had denied allegations that grand jury proceedings were marred and argued that Baldwin made “shameless” attempts to escape guilt, highlighting contradictions in his statements to authorities, safety regulators at the scene at work and in a televised interview.
