Parents of Massachusetts boy who died after eating extra-spicy fried food file lawsuit

BostonThe family of a teenager Massachusetts who died after participating in an extra-spicy fry challenge that was widely promoted on social media filed a lawsuit Thursday against Hershey, Walgreens and others involved in the case.

Harris Wolobaha 10th grade student from the city of Worcester, died on September 1, 2023 after eating the Paqui chip as part of the “One Chip Challenge” launched by the manufacturer.

“Today we filed a wrongful death lawsuit on behalf of this wonderful family for the loss of their beloved son, Harris.”said Douglas Sheff, one of the attorneys representing the family in the lawsuit filed in Suffolk Superior Court. The suit seeks a court-determined sentence that would include punitive damages.

Harris died of cardiopulmonary arrest “in the context of recent ingestion of a food substance with a high concentration of capsaicin,” according to the autopsy by the coroner’s office. Capsaicin is the component that gives chili peppers their spiciness.
